Grandparents Rights in Arizona

In Arizona, grandparents and even great-grandparents often have a legal right to maintain contact with their grandchildren. Although grandparents rights are subject to strict conditions, grandparents can – and often do – gain visitation orders through the courts.

In order for grandparents to apply for visitation rights, at least one of the following conditions must apply:

  • The child’s parents’ marriage must have been dissolved for a minimum of three months.
  • The child’s parent(s) need to have been declared officially missing for a minimum of three months.
  • A parent must be deceased.
  • The child needs to have been born out of wedlock.

Even when one of the above conditions does apply, Arizona courts will still prioritize the child’s best interests, making it essential for grandparents to present their motivation for seeking visitation rights to the court in the best light. In these circumstances, an expert attorney is essential to achieving the best possible outcome.
