There is a law in the state of Arizona that covers the “recovery of attorney fees.” These are some of the situations listed in Title 12, Chapter 3, Article 5, Section 12-341.01, wherein a judge might award attorney fees.

  • If the contested action arose from a contract, either implied or expressed, the court may award reasonable attorney fees to the successful party.
  • In a contested action, if clear and convincing evidence is provided to the court, showing that the claim or defense is groundless, constitutes harassment, and was not made in good faith, the court may award reasonable attorney fees.
